The player from Denmark wishes his deposits to be reimbursed since the casino doesn’t hold Danish License. After a closer examination, we ended up rejecting this complaint as unjustified.
Stake.com have changed TEOS without any notice, and compliance department is ignoring me a copy of the old terms and some basic questions I've asked them.
I company can simple not just write that you agree to the terms will be updated without notice, this has already been settle in court before stated invalid because you can't agree to terms not yet made.
I'm asking for the following:
I got a lot or proof, alså that Stake still allows players to join from restricted areas.
I got proof that AML limits was violated.
I've tried to contact Stake multiple times some months ago, and they do not reply, Im writing here because Casino guru helps them be accountable.
Dear d4n13n,
Thank you very much for submitting your complaint. I’m sorry to hear about your problem.
Unfortunately, we at Casino.Guru don’t deal with complaints related to licensing regulations and policies. I understand your point, but, sadly, we’re not in a position to help you. We are an independent online casinos database which acts as a mediator in resolving players’ disputes. We have no authority to enforce the legality of rules.
Unfortunately, in this case, we are not able to help you and you are not entitled to any refund of your deposits. I can only recommend you to do better research next time and play only in the casinos licensed by the Danish Licensing Authority.
Please let me know, if there is anything else, I could do for you regarding this case, otherwise, I will be forced to reject your complaint. Thank you for your understanding.
Best regards,
Petronela
Stake casino changed the terms and conditions, I’m asking for a copy of the old TEOS, this is not a policy or a licensing request.
Im not asking for a refund on this complaint.
And I’m just stating that it’s illegal and against Danish law that Stake allows Danish players to sign up and gamble on their sites, and your site promoting Stake as "Accepting Danish players" is as well so that should be changes asap!
Thank you, d4n13n, for the clarification. I have changed the setting in our database.
We accept the situation when the casino allows players from restricted countries to open an account as long as they don’t use this as an opportunity to later cancel the player’s legitimate winnings. Simply said – if the casino allows players from restricted countries to deposit and play, they should pay out their winnings as well.
Therefore, I would like to emphasize, that we investigate further and help only those players, whose funds (or winnings) have been confiscated due to being from a restricted country. Nevertheless, it doesn’t seem that this is the case here (but correct me if I am wrong, please).
Please let me know if there is any additional information that I have overlooked, but I’m afraid I will be forced to reject your complaint as unjustified. I wish I could be of more help. Thank you in advance for your reply and understanding.
That didn't help me. I got the old TEOS so at least I found it myself.
Sweden and Switzerland is also market as "Accepting Players" but its stated in their terms that they are prohibited.
Thank you, , for your reply. I have added Denmark and Switzerland to restricted countries (still haven't found Sweden in the T&Cs):
"JURISDICTIONS. Persons located in or reside in Afghanistan, Australia, Belarus, Belgium, Côte d'Ivoire, Cuba, Curaçao, Czech Republic, Denmark, Democratic Republic of the Congo, France, Germany, Greece, Iran, Iraq, Italy, Liberia, Libya, Lithuania, Netherlands, North Korea, Ontario, Portugal, Serbia, Slovakia, South Sudan, Spain, Sudan, Syria, Switzerland, United Kingdom, United States, Zimbabwe (the "Prohibited Jurisdictions") are not permitted make use of the Service. For the avoidance of doubt, the foregoing restrictions on engaging in real-money play from Prohibited Jurisdictions applies equally to residents and citizens of other nations while located in a Prohibited Jurisdiction. Any attempt to circumvent the restrictions on play by any persons located in a Prohibited Jurisdiction or Restricted Jurisdiction, is a breach of this Agreement. An attempt at circumvention includes, but is not limited to, manipulating the information used by Stake to identify your location and providing Stake with false or misleading information regarding your location or place of residence.
The attempt to manipulate your real location through the use of VPN, proxy, or similar services or through the provision of incorrect or misleading information about your place of residence, with the intent to circumvent geo-blocking or jurisdiction restrictions, constitutes a breach of Clause 5 of this Terms of Service."
However, I’m sorry we couldn’t help you to resolve this case, but please do not hesitate to contact us if you run into any issues with any other casino in the future. For the abovementioned reasons, I will now reject this complaint. Thank you for your understanding.
