As I said, if things go normally, then the lawyers are all there. But if it becomes difficult, the answers will also become difficult.

However, I am of the opinion that a Maltese court should not have appealed to the European Court of Justice because of a law that violates EU law, which the European Court of Justice will certainly see the same way and will then initiate infringement proceedings. It's all just delay.
So maybe you can remember that here in Germany, someone once won against Pay Pal in front of the LG Ulm. This then went before the Stuttgart Higher Regional Court. SINCE Pay Pal is based in Luxembourg and he used a business account because he had a business account with PAY Pal, THE Stuttgart Higher Regional Court presented THE case to the ECJ. Unfortunately, older passed away at the beginning of 2020, in April. The case is inheritable when the inheritance is received. It's part of the inheritance. Unfortunately, this has not been continued until now. The Higher Regional Court did not make any further judgment. He was only 40 years old 😊. Well, 8 years, I think that's easy... I've been waiting exactly 3 years... I think the ECJ will be in 2025-2026 and then initiate execution in Malta... you're easily at 6-8 years...

PayPal and online gambling: OLG Stuttgart asks ECJ
The Ulm regional court ruled in our client's favor: PayPal was then used as a payment service for illegal gambling offers and was liable for losses. PayPal did not accept this judgment and appealed to the Stuttgart Higher Regional Court.
As we have already reported, the judges there announced in the oral hearing on October 30, 2020 that they would refer the matter to the European Court of Justice in order to have the international jurisdiction of the German courts determined.
This is necessary because the proceedings before the Stuttgart Higher Regional Court involve an unusual set of facts: the player paid from a business account. The detour to the ECJ has nothing to do with the usual consumer use of PayPal services. This development is therefore of little relevance to the vast majority of gamblers. What is positive, however, is that the issue of payment services for illegal offers is now receiving further attention.
We now have the verbatim decision of the Stuttgart Higher Regional Court.
Accordingly, the 5th Senate of the Stuttgart Higher Regional Court leans towards the international jurisdiction of the German courts. If there is an allegation of payment involvement in illegal online gambling, the place of success should be located at the player's place of play, as long as this place corresponds to the place of residence of the injured party.
It remains to be seen how the European Court of Justice will position itself.
Unfortunately, the ECJ will not comment on the ban on participation in accordance with Section 4 Paragraph 1 Sentence 2 GlüStV. We continue to hope for a decision from the Federal Court of Justice.

3 years since the lawsuit... my case hasn't even been executed in Malta yet... So I'm pretty sure (I just spoke to a friend recently, I have the same opinion) that (as far as Austria is concerned at least) the companies will file for bankruptcy, because then that's the case Many judgments have accumulated and they then say that it is no longer economical to continue the company and that is why the end of the area. Pop new company with new CEO and let's move on. And that is not forbidden and an ex-GF is not liable… it is simply a "normal" inso… and that is nothing forbidden.
