This is currently being decided by the Eugh, based on the call from Malta. If the law is deemed to be contrary to EU law, contract infringement proceedings will begin. But actually they don't even have to, because the legal situation is clear in Europe, ruled by the ECJ in 2009 and only recently in 2023.
If I'm not mistaken, you definitely can't sue the ZDL, but you can see which account the money goes to. You then have to file a claim against the ZDL to find out where the money went.
The good thing for me was that I only paid all payments via Klarna and Pay Pal. And Pay Pal said exactly which operator would get the money.
Furthermore, operators can change, but the parent company usually remains the same, so you can then sue the parent company. That's how it was for me back then, 777 changed operators, but of course the parent company remained the same. That's why my parent company was sued. With Bayton it was even easier because Klarna transferred directly to Bayton's own account. Of course, the Deutsche Handelsbank did not provide any information. In my case, you could even have sued the Handelsbank because they had a direct business relationship with them. As far as I know, the Handelsbank, before the reform, ended the business relationship with Bayton, for whatever reason(😁😁😜)

These judgments from Malta will all be considered null and void because this new law will not stand. In my case, the operator changed during the proceedings here in Germany, and my lawyer simply expanded the lawsuit to include the parent company.
Of course, I'm not a lawyer and I don't know what happens if the operator closes down. But I also seem to remember that if a new operator takes over the site that someone else previously offered where you lost, these funds or losses also pass to the new operator.

As far as I understand some of the judgments and opinions of some lawyers, you of course have the chance to seize the managing director. Most of the time, the managing director also belongs to a parent company or the collapsed Ltd. Then the parent company should actually be liable. By the way, judgment can also be made in Curacao, because they belong to the Netherlands Antilles and therefore the Dutch state area. They have adopted some EU laws. There are already some judgments from Germany, e.g. B. LG Hamburg, from 2023
