The opinions and assessments of how "Bill 55" impacts or could impact are very interesting. In my opinion, this law is purely about "wasting time" for the benefit of gambling operators who are "unauthorized" in some countries.
I expressly emphasize: What I have presented below is not legal advice, but rather my legal opinion. I can only expressly recommend that everyone get good legal advice!
So: The respective laws of the country in which the player is a national and plays regulate the legality of gambling (valid license or illegal gambling) and case law clarifies the right to reclaim through a judgment. This judgment is an "enforceable title" (!) (applies to German legislation) that is valid for 30 years and is therefore enforceable "Europe-wide"!!!
So if a Maltese gambling operator outside of Malta(!!) has a bank account, cash, real estate or other assets in any other European country, this title can be "executed" against him, in plain language "it can be seized", because Bill 55 and that "Delaying" "executions" only applies to Malta. This of course makes enforcement more complicated, more labor-intensive and more expensive (!) - "Malaga" has already written this clearly several times (!!!).
So why "Bill55"? What is the purpose of this "European illegal law" (according to the unanimous opinion of eminent lawyers) that (a???) Maltese MP introduced (has) and that was passed at "record speed"! In my opinion there are essentially two reasons:
I am convinced that everyone who has a valid title or is now obtaining one by filing a lawsuit against a casino without a valid license (after detailed legal advice from a qualified lawyer, of course...) will get their money, because at the latest ECJ will accept this "Bill55". This may take time, but everyone who has "fallen for" these companies may realize that if they hadn't played, they wouldn't have to complain now, because if they had played in a legal casino and lost, their money would be irretrievably gone ( !!!).
And: Don’t "gamble online" and if you can’t stop it, then definitely not in a "Maltese casino".
Anyone who ignores the law and ignores court decisions and is "protected by law" from the state if the worst comes to the worst is " particularly trustworthy" - right??? - and in the case of the "big win" transfer it to you quickly, "with thanks" and "Hosanna" on your lips, without you having to sue and/or send the bailiff...
