The player from Germany wants his deposits to be returned because he managed to register as 16 years old. The player provided incorrect details in order to create an account, which is a serious breach of the casino's T&Cs and we were forced to close this complaint.

Good day,

I am 16 years old and paid € 5080 on the Stake7 site.

I applied to support for a refund in accordance with §5.7 (reimbursement of deposits to minors).

Unfortunately, the casino did not want to adhere to its own terms and conditions and came up with the following "excuse":

------ beginning of quote

Hello Mr. B ***,

Unfortunately, you are not entitled to any repayment in this case. According to our terms and conditions, which you accepted when registering, it is your responsibility to state your date of birth accurately and correctly.

We refer to the following clauses:

"5.1. You warrant that:

5.1.1. You are not younger than:

5.1.1.1 . 18 (eighteen) years; or

5.1.1.2 . Any legal minimum age required for gambling or gambling activities under applicable law or jurisdiction that applies to you ("the legal minimum age"); and

5.1.2 . The data provided when opening your account are correct; and

5.1.3 . You are the legal owner of the funds in your account. "

The clauses under 5.7 refer exclusively to cases where an underage person with an accurate date of birth has managed to register on our site. In your case that would be your real date of birth: 02.03.2004. However, since you deliberately entered your date of birth incorrectly (as 02.03.2002) in order to bypass the youth ban, you are not entitled to a refund.

----- Quote end

Since in my opinion this "excuse" has no legal value, since it is assumed with §5.7 that the previous § was disregarded, I hope for a refund.

In addition, §5.7 does NOT say "If she should be able to get in despite the protection of minors, your stakes will be refunded", but very clearly "You are a minor? You can prove that you are a minor? Then you will get your deposits back . "

I really hope you can help me somehow ...

Stay healthy and I wish you a nice week 🙂

lg

Dear Neils,

Thank you very much for submitting your complaint. I’m sorry to hear about your negative experience. First of all, I would like to emphasize, that you must be at least 18 years old to play in online casinos.

I checked the registration form and the youngest players could choose the year of birth 2002. The casino wasn’t able to recognize if you are a minor or not because you knowingly stated your birth date incorrectly in order to create an account. By this you breached multiple T&Cs, which the casino pointed out. Unfortunately, in this case we must stand on the casino’s side, and we believe you are not entitled for a refund.

Please, DO NOT create an account in any casino until you reach the legal minimum age for such activities.

Do not hesitate to contact us if there is anything else, we could do for you, otherwise, I will be forced to reject this complaint. Thank you very much for your understanding.

Best regards,

Kristina

Hello Kristina.

Thanks for the quick response 😉

Unfortunately, I don't see it like you ... The casino has clearly stated in the terms and conditions that deposits by minors will be refunded if they prove to be a minor.

From a legal point of view, the clause that refunds to minors naturally includes that previous clauses (such as 18+) were knowingly or unknowingly disregarded.

The casino is not allowed to accept minors' funds and certainly not to keep them.

Hello Niels,

I understand you are referring to this term:

"5.7. If we are unable to confirm that you are of Legal Age then we may suspend your Account. If you are proven to have been under that age at the time you made any gambling or gaming transactions, then:

5.7.1. Your Account will be closed;

5.7.2. All transactions made while you were underage will be void, and all related funds deposited by you will be returned;

5.7.3. any stakes for bets made while you were underage will be returned to you; and

5.7.4. any winnings which you have accrued during such time will be forfeited by you and you will return to us any such funds which have been withdrawn from your Account."

However, our standpoint is clear:

If you stated your details correctly and the casino allowed you to register and play - you would be entitled to a refund, because in this case it would be the casino's mistake (a very serious mistake).

But in this case you managed to register by providing incorrect details (because your year of birth wasn't available to choose), and, unfortunately, the casino isn't responsible for your mistake.

I would love to help you with this but, sadly, under these circumstances there is nothing we can do, and I am forced to reject your complaint.

Niels, again, please do not play in any casino until you reach the legal minimum age of 18 years.
