Dear Casinoguru,


The Company (sons of slots) misled me into believing they have a license for the Netherlands and could transact with Dutch citizens, however this is an illegal transaction. I checked the terms & conditions and the Netherlands was not listed as restricted country. My passport and utility bill was verified. Because there was a completely dutch payment option, it made me believe it was a full licensed and trustworthy casino. When I checked the withdrawl option they have it says Brite. When I clicked the payment option to deposit 'Brite' it clearly stated it wasn't prohibited from my location. This made me look further into it. After some search on the internet, Sons of slots has no license for the Netherlands.


The dutch authority, NGA says: 

Dutch:

Let op: illegale gokbedrijven die vanaf 1 oktober niet bereikbaar zijn voor spelers in Nederland moeten er wél voor zorgen dat u uw geld terug kunt krijgen.

Krijgt het bedrijf geen vergunning, dan mag het geen kansspelen aanbieden in Nederland.


Translation in English:

Please note: illegal gambling companies that are not available to players in the Netherlands from 1 October must ensure that you can get your money back. If the company does not receive a license, it is not allowed to offer games of chance in the Netherlands.


I looked into other casino's and they're all restricted from the Netherlands. Casino's where I had an account before the first of october, also informed me they'll close my account due to chances in law.


I send Sons of slots an e-mail and kindly asked for a refund of deposits (€4413,-) as what they're doing is illegal, and misleading.


After a week I received an e-mail back, and they stated:


2.5 In opening your account you warrant that:

2.5.3 Gambling is not illegal in the territory where you reside;


and therefor could not refund my deposits. Since it is legal in The Netherlands, but Sons of slots doesn't have a license, which is illegal (and most of all super illegal and misleading to use a complete dutch payment option), I think I'm in my right to ask for a refund of deposits.


I also told them that if they won't coöperate, I'm forced to inform the dutch authorities as well as the malta authorities (the license they have).


NGA says the following:

"Een belangrijke verandering in het beleid is dat de boete voor het illegaal aanbieden van online kansspelen, fors wordt verhoogd. Die hogere boetes gelden voor zaken die in nader onderzoek worden genomen vanaf 1 oktober.


Als de omzet van een illegale aanbieder hoger is dan 15 miljoen euro, wordt de boete gerelateerd aan de omzet en bedraagt 4 procent daarvan.


Als de omzet van het bedrijf niet bekend is, schat de Kansspelautoriteit de hoogte. Is de omzet van het bedrijf in kwestie lager dan 15 miljoen euro, dan bedraagt de basisboete 600.000 euro."


Translation in english:

"An important change in the policy is that the fine for illegally offering online games of chance will be significantly increased. These higher fines apply to cases that are taken into further investigation from 1 October.


If the turnover of an illegal provider exceeds 15 million euros, the fine is related to the turnover and amounts to 4 percent of that.


If the turnover of the company is not known, the Gaming Authority estimates the amount. If the turnover of the company in question is less than 15 million euros, the basic fine is 600,000 euros. "

Is here anyway Casinoguru can help me out? The customer service through mail is very slow and through chat they aren't able to help me with this.

"2.6.4 No customers will be accepted from Afghanistan, Anguilla, Antigua and Barbuda, Bangladesh, Cayman Islands, Cuba, Cyprus, France, French Guiana, French Polynesia, French Southern Territories, Greece, Guadeloupe, Guernsey, Guyana, Hong Kong, Hungary, Iran, Iraq, Isle of Man, Israel, Italy, Lebanon, Libya, Lithuania, Macao, Malaysia, Martinique, Mayotte, Myanmar, Philippines, Reunion, Saint Martin (France), San Marino, Saudi Arabia, Sint Maarten (Netherlands), Spain, Sudan, Suriname, Syria, Taiwan, Tunisia, Uganda, United Kingdom, United States, Virgin Islands, U.S, Yemen and Zimbabwe. These countries shall be considered "Excluded Territories"."


Could you please advise why do you believe that Netherlands should have been listed between restricted countries? How much is your active balance now?
