I send an valid and correct claim to Scatters casino first week of May and despite I pushed them every week during four month, they simply ignore it and obviously decided to handle clients claim by not act or answer.

I have also asked them many times to send me my made transactions as well as copy of theirs previous T&C due to they changed them after they received my claim, but also there just totally silence.

Even the worst blacklisted scam casino´s normally answer anyway, while Scatters casino just simply don´t care.  

 

Background on my claim is that I having a problematic playing addiction as I went into after my divorce six years ago. 

It all ended up so badly that I was hospitalized for my addiction under three month during 2018.

I started at that time to use the Swedish playing tool game break which locked myself for all gaming at all casinos whom have license in Sweden, and by law can approach players in this market. 

According to the Swedish law from January 2019, only casino whom have license in Sweden have legal right to act here and to approach Swedish player.

It is stated clearly that a casino without Swedish license are making an criminal action if they in any way do marketing or process Swedish players. 

To offer bonuses or campaigns except the first welcome- bonus is also strictly forbidden, even for a casino with license.

 

1: Scatters VIP staff did without Swedish license during 2020/2021 active and deliberately processed me on weekly basis with running campaigns, bonuses

and cashbacks encourage me to play, despite they very well know it´s against the Swedish law. I have whole binder of material that proofs this.  

  

2. CJEU has have repeatedly recognised EU countries’ rights to restrict the cross-border supply of certain gambling services where necessary to protect public interest objectives such as the protection of minors, the fight against gambling addiction, and the prevention of crime and fraud.

  

3. Scatters T&C (contract) will be classified as unfair according to EU Directive 93/13 of 5 April 19, and a company’s T&C doesn’t go above country laws and EU directives. 

  • T&C (contracts) shall not obliging the consumer to fulfil all his obligations where the seller or supplier doesn’t. 
  • It must take the necessary measures to ensure that the consumer does not lose his protection. 
  • Member States shall lay down that unfair terms used in a contract concluded with a consumer by a seller or supplier shall, as provided for under their national law, not be binding for  consumer. 
  • The fine for breaking these terms must be set to 4% of the company´s turnover, but minimum euro 2 million. 

 

4. It is also stated according to Chapter 19, second paragraph of the Swedish Gaming Act: "there is an obligation not to provide Payment Solutions to casino whom lack a Swedish license". I have thereby asked Scatters repeatedly for my made transactions, but they refuse to answer that as well.

 

5. It was on top of all this also quite obvious for Scatters that I had a heavy playing addiction. 

One example was when I had an balance of euro 75.000 and wanted to make an withdrawal in August 31 -2020.  

Then they suddenly asked for huge many additional document despite I was verified already.

But when I sent all that asked additional docs as they wanted, my withdrawals was still not processed 5 days later. 

In the end I played it all back of course as they waited for, and after that they gave me a lot of big free bonus money and encourage me heavily to continue. 

All this correspondence is saved of course. They on the other hand never asked for such extra documents during my huge deposits, as they must according to theirs T&C.

 

6. There where two other casinos involved in my claim process for same issue and both of them chose an settlement instead of a process.

They of course understood that they had broken the law, while Scatters decided to not even answer. Scatters have got proof on these settlements as well. 

 

7. My damage is so much more than just money, but I choose to legally only demand reimbursement for my net loss euro 59.180 as I made with Scatters

during 2020/2021 when theirs loyal team against the Swedish law and EU directives, processed me more or less every day by phone and mail.

What do you do when Scatters casino does not respond to me or the forum's staff for four months on a valid claim of SEK 705,000?

They also do not send my requested completed transactions or copy of their previous terms and conditions which I want as they changed their T&C after my claim.

Just total silence, not a response and MGA doesn't respond to emails either.

was not listed on casino guru so I selected the complaint under Rant casino which belongs to same owner. I.e Gammix Ltd.

What should I do when Scatters casino/Gammix Ltd does not respond to me or the forum staff to my valid claim of €59,000?

They are also not sending my requested completed transactions or copies of their previous terms and conditions that I want because they changed their terms after my claim.

Just complete silence, not a single answer.

By the way what is MGA good for, they also don't respond when I report this casino that simply ignores customer claims.

I can’t find that link- page anyway and Scatters casino is not on your list when I do an claim- report. Maybe it’s like that because I am entering from Sweden and Sweden is a restricted country for them?

But maybe it’s no meaning for the time being because I also informed Casinomeister about it, and they got reply from the casino today that my case is under legal investigation, which takes time as well as are the reason that no one are allowed to answer me. Let’s see if this is correct information or not, even if I am a bit skeptic after my experience with Scatters. / Jan K

Oh,.. this is a sad story, and I'm sorry for all you have been through! I believe you are a strong person capable of overcoming such a horrible experience.

I appreciate your honesty and the complexity of all the legal aspects you included in the post. Well put.

Hopefully, justice will be served though, I imagine there is still quite a long run before you.

What do you expect shortly? Or better say - any expectations given by a lawyer, perhaps?

Thanks a lot for your kind words and understanding. I just hope for some justice and to get main- part back of the losses from that casino to pay some of my debts with, which was one of the consequences from theirs un- legal and bad behavior against me/ Jan K

Keep fighting, but if I may be so bold, try to find a little moment of happiness and joy because this path you are on must be hardly demanding! Don't let yourself get consumed in the process. I have been getting the same repeated response for 6 months now, ie my complaint is sitting on the concerned department's desk, and support is still giving the same response.

But I have also recently reported it to KGC as Scatters casino changed their license from Gammix Ltd/MGA to Starscream Ltd/KGC at the end of July.

KGC then replied to me two weeks ago that Starscream Ltd are rejecting and thus ending my claim against them, based on Scatter's breach being made when the license was under Gammix Ltd - MGA.

Scatter's support, which is now under Starscream Ltd, still continues with the same lies as before, i.e. that it is on the desk of a relevant department.

They knew my claim was correct and thus used this lousy lie to wait for Scatter's license transfer, thus trying to avoid my claim.

I've asked Scatter support if it's KGC or them lying to me, but never got an answer or explanation about that either.

The claim, which is 59,180 euros, is a confirmed claim as I received compensation from two other casinos in the same case.

I really hope that scatters.com won't get away without consequences by just completely neglecting to respond. I have received help from a casino forum but no answers from Scatters to them either.

Yes it have been a heavy struggle during an half years time now and I am quite sure that Gammix Ltd just waited it out until they changed license. I however wonder if they sold Scatters to Starscream or if it’s some kind of co- operation, or maybe still same company but just another name.

They have however decided to not do anything or even answer me now.

I really hope they get blacklisted before they play such lousy game out of rules with someone else.

I have by the way issued a claim on it here but it was not accepted due to the time frame since the breach was done.
