Case summary

The player from Canada had his account suspended for violating the T&Cs by using his girlfriend's card via Apple Pay. The casino only refunded his last deposit of $30. Despite the player's clarification that Apple Pay was in his name, the Complaints Team explained that the funds originated from his girlfriend's card, which breached the casino's rules. Consequently, the complaint was rejected, and the casino's decision to confiscate the winnings was upheld.

the casino said I violated t&c by depositing with my Apple Pay. My girlfriend’s card was on it. They told me that "11.4 Using third party payments is prohibited. You must make deposits only from a bank account, bank cards, e-wallets or other payment methods that are registered in your own name. If we determine during the security checks that you have violated this condition, your winnings will be confiscated and the original deposit will be returned to the owner of the payment account. The Company is not responsible for the lost funds deposited from third party accounts." I made 470$ in Apple Pay deposits and they will only return the last deposit. They say that   "Alex Manager Wed, 06/05/24 2:13 am  We cannot refund played deposits. We kindly request you to cashout 30 CAD to holder's bank account (via Interac)."

They put that 30 into my casino account. I played it out long before I asked for a cash out.

Dear mdinvestll,

Thank you very much for submitting your complaint. I’m sorry to hear about your problem. Apart from the rule in the Terms and Conditions the casino provided you with, please check our Fair Gambling Codex for Players

"For deposits and withdrawals, you should only use bank accounts and credit cards held in your own name. If you don't do this, you might get into trouble when trying to make a withdrawal. This rule is mostly in place to prevent credit card misuse and also because of international anti-money-laundering regulations."

Please understand that this rule has been breached. Some exceptions might be allowed by casinos when depositing or withdrawing funds using a joint card or this possibility is communicated beforehand. Technically it is very difficult to check who’s the owner of the payment method at the depositing stage. This can be checked only during the account verification, which is usually done when a withdrawal is requested. Therefore, it is a player’s responsibility to use allowed payment methods only.

If you’re not able to prove that you are a legitimate owner of the payment method and you haven’t received approval from the casino allowing you to use a third-party payment method, I’m afraid there’s not much we can do for you.

Moreover, the casino will refund the owner of the payment method only for deposits that were not used for playing. If you have spent the deposited money, I am afraid you are not eligible for a refund.

Thank you very much in advance for your reply and understanding.

Best regards,

Veronika

The Apple Pay is under my name. It uses an Apple Pay number . The credit card is just where it draws the money from

"The credit card is just where it draws the money from" - This means that you deposited money that belongs to your girlfriend. I'm sorry but the casino is eligible to confiscate your winnings, since you deposited with funds that do not belong to you.

Due to the aforementioned reasons, this complaint will now be rejected. Thank you for your understanding, I am sorry we could not be of more help on this occasion. Please do not hesitate to contact us if you run into any issues with this or any other casino in the future.
