Case summary

The player from the United States had managed to accumulate significant winnings but had faced difficulties during the withdrawal process. He had been accused by the casino of breaching max bet rules by betting $60 on the 'Wizards Jackpot' game, which he insisted was a cost to play a bonus round, not a bet. The player believed the casino was intentionally misinterpreting the game rules to withhold his winnings. After reviewing the case, we had concluded that the casino had applied its terms and conditions in a common way how the max bet rule was interpreted and enforced by online casinos in games with any 'features'. Thus, we were unable to assist the player in this case.

Last Sunday I took a 200% bonus and deposited $100 which gave me a 15000 play thru. Playing hour after hour I finished the play thru and ended up with a balance of 6479. I allocated 2500 withdrawal their max per week. That left me with $3979.00 in my account. Of course its hard just to let it sit their so i decided to play and try to win more. Well I lost 2K over the next few days. My balance now was $4466.00. I contacted customer service and ask about my pending withdrawal. They said I need to send my documents in. I sent them in immediately and the next day I was approved. I allocated another withdrawal which at that time was only 2000. Today I received an email that I breached the max bet rule. First off. I know the rules at Drake and I abide by the rules. In fact, I contacted customer service when I first deposited to make sure of the max bet which is $25. They said I made a $60 bet on a game called Wizards Jackpot.

LETTER FROM DRAKE.

This is regarding your account with us.

Considering you had requested two withdrawals for a total of $4,466.00 (excluding $80.00 in fees), we would like to let you know that we have conducted our standard account review before processing these and it turned out that unfortunately you have broken a certain rule of ours when it comes to wagering with bonus funds. Namely, whenever you are collecting rollover points towards fulfilling the respective wagering requirement, you shall not do slot spins for more than $25.00 each as this is forbidden. That includes any in-game features that increase your spin value. It leads to all rollover points and any money you might have gained during or after that occurrence getting voided.

Since there are many such spins made by yourself – initially one for $60.00 on the Wizards Jackpot game – during play towards the ‘Sunday Funday 200% Cash (VIP)’ bonus that you’ve accepted on November 5th, we have now cancelled your withdrawal request and brought your account standing to the point exactly before you made that spin.

At this moment you have $720.93 available in your balance and you’ve collected a total of 502.69 rollover points, meaning you need to accrue 14,497.31 more points to fulfill the requirement. Once you’ve done so, you will be able to place a new withdrawal request as long you don't accept another bonus in the meantime.

If you have any questions, feel free to contact us at any time.

Kind regards,

Richard

I asked them for the game panels that show the bet and the outcome of that spin. All these games have a panel game spin number so it can be investigated. I told them I have a right to see the game panel if you are accusing me of a breach.

After doing some research I signed into my account at Drake and went to that game Wizards Jackpot. On the bet size tab clicking upwards there is no bet of $60. there is a $1 thru $50 and then the next size is $75. I then contacted customer service and told them this. They said I made the bet on the BONUS BUY IN. This is a link so if you want to buy the bonus you can. The bonus buy in is based on your game bets. If you are betting 1 dollar and you click on the bonus buy in It says do you want to pay 30 dollars for this bonus. That is what it costs the player to play the bonus and possibly win more. It is not a bet it is a cost SEE ATTCHED OF THE BONUS BUY IN.

file THE BET SIZE IS $2 ---- IT WILL COST YOU $60 TO PLAY THE BONUS. THAT'S MY BREACH. THE $60 IS NOT THE BET SIZE.

THIS PEOPLE AT DRAKE JUST DO NOT WANT TO PAYOUT MY WINNINGS. THEY MANIPULATE THE MANUFACTURERS DESIGN OF THE GAME SO THE PLAYER BREACHED THE RULES.

THIS WAS A 2 DOLLAR GAME BET NOT $60

Dear zena5755,

Thank you very much for submitting your complaint. I’m sorry to hear about your negative experience. I checked the bonus T&Cs and I found this:

"All bonuses have a minimum dollar value of wagers that must be reached before you will be permitted to withdraw. This is referred to as the "wagering requirement". Unless stated otherwise, when playing with bonus money, you may not wager more than $25 per spin in order to clear your Wagering Requirement. This includes double up wagers and gamble features. Drake Casino reserves the right to void all winnings if a player bets over the max bet amount. The deposit and bonus will be returned to the player with the bonus wagering requirement reset to zero fulfilled."

Our position is closely explained in Fair Gambling Codex :

The max bet rule is, in fact, an industry standard, just as the fact that a casino has the right to seize the player's winnings from bonus play after breaking this rule. We prefer not to go against industry standards by penalizing casinos that use the maximum bet rule against players from time to time.

However, if you feel like you have been accused mistakenly, feel free to forward me your game history. My email address is kristina.s@casino.guru.

If there is any other relevant communication between you and the casino, please send it as well.

Thank you in advance for your reply.

Best regards,

Kristina

My game history is not available on their site. The only thing it shows is the game you played and how much you won or lost not how much you bet per spin. They hide that part. They are saying that when I bought into the buy in bonus which is available on the game screen it cost me 60 dollars even though my bet size was 2 dollars. Every slot game has a bonus round of free spins that could pay you nothing or pay you a big win

.this game Wizard Jackpots has an option not to wait for a bonus round to occur it says you can buy into a bonus round now by clicking on the bonus buy in tab.

My bet size was 2 dollars but the bonus buy in says that this bonus will cost me 60 dollars to play. The 60 dollars is deducted from your account balance. My bet size did not change.

Look at the photo above. Bottom left corner you will see what my bet size is $2. The 60 is the cost to play which is deducted from your account.

They are saying that buying a bonus round ups the bet size for a potential win . All slots have a bonus round.. that is the exciting part of a slot game free spins and a chance to win more money at a higher win or you can win nothing also. It is a chance only buying a bonus. There no guarantee you will be a big winner. They should disable all bonus buy ins. Any player that uses a bonus buy in's with a match bonus loses instantly but doesn't know that until you finish your play thru and make a withdrawal besides sending in all the documents required. Then they take your winnings awayfile. Very unfair tactics

They hide the games panels from players .That 60 breach as (they say I placed ) won me nothing. It was a $2 bet with a 60 buy in. Just a way of not paying another winning player. see below

It states I won $328 on 41 games played. wow if that was a real $60 bet I probably would have won $328,000.

and it would have cost me $1800 to play the bonus round at that bet size. Its $30 per $1 bet size.

There was no $60 bet placed. To play the bonus round the game charges you $60 that gets deducted from your account balance. Pictures don't lie. my bet size shows at the bottom left of the BONUS BUY IN PAGE 2 dollars.

The game charges you a fee based on your bet size to be able to play a free spin bonus round. Drake apparently says in their terms & conditions you are not allowed to use feature rounds or bonus buy ins. Every slot game has a free spin bonus round attached to it. It could be a winning bonus round and it also can be a losing bonus round. I have noticed while playing that not many bonus rounds hit often, I guess they have a way to stop that from happening. Some games like Wizard Jackpots have a option to buy in to a bonus round with free spins. The game I won most of my winnings on was triton at a 20 dollar bet lower than their max allowed. This game had no buy in available. I won 4800 on this game. Drake took all my money based on a $2 BUY IN BONUS from a different game.

They should not be allowed to be in business, Scam Casino!

At the top of this page click this photofile

It says- DO YOU WANT TO PAY ($60) TO PLAY A BARTLEY'S COLLECTION BONUS. YES OR NO?

It does not say -Do you want to bet $60 to play Bartley's Collection Bonus

and at the bottom of the page it shows my bet ($2 dollars)

AND THEN AT THE VERY BOTTOM IT SAYS BONUS WINNINGS WILL BE CACULATED ON THE CURRENT BET SELECTED $2.00. (2 dollars) I see this, I am sure you see it. Why doesn't Drake casino see it. The game is telling you if I select yes bonus winnings will be calculated at the current bet selected which is 2 dollars. Then why am I being accused of breaching their rules. $60 is what it costs to play the game but the winnings if any are based on my bet of 2 dollars.

I BREACHED NOTHING!

DRAKE'S BONUS TERMS AND CONDITIONS

All bonuses have a minimum dollar value of wagers that must be reached before you will be permitted to withdraw. This is referred to as the "wagering requirement". Drake Casino reserves the right to void all winnings if a player bets over the max bet amount. ALL MY BETS WERE UNDER THE ALLOWABLE MAX OF $25. I DON'T USE DOUBLE UP WAGERS AND THE GAMBLE FEATURES (IF THEY ARE REFURRING TO THE FEATURE ROUND OF FREE SPINS) IS BUILT INTO THE GAME BY THE SOFTWARE MANUFACTURER. SO IF THE GAME LANDS ON A FEATURE ROUND WHAT DOES A PLAYER DO? CLOSE OUT THE GAME AND DON'T PLAY THE FEATURE. EXTREMELY UNFAIR BONUS TERMS!

Dear zena5755,

I went through everything you sent and I checked the game to understand how it works. Please note that many casinos do not allow players to use any features while the bonus is active. Nonetheless, we believe that the max bet rule should apply on a 'per-spin' basis. For example, if you buy a feature that awards you 10 spins, even if the purchase was above the max bet specified in t&c, this should count as 10 bets being made with 1/10th the value of the purchase.

However, the feature in this particular slot launches a different game, where a jackpot can be won. This simply means that the amount of funds you paid to launch this feature ($60) is equal to a bet on a single 'spin'. therefore will not be able to help you.

Please understand the way the casino applied its terms and conditions in this particular case is a common way how the max bet rule is interpreted and enforced by online casinos in games with any 'features'.

Due to the aforementioned reasons, this complaint will now be rejected. Thank you for your understanding, I am sorry we could not be of more help on this occasion. Please do not hesitate to contact us if you run into issues with this or any other casino in the future.
