Unjustified complaint

REJECTED

Case summary

The player from the US, who had been using the casino since 2020, complained about blocked access due to VPN usage and the inability to withdraw the remaining balance. The player had been aware of the casino's prohibition of VPN usage, yet continued to use it, which led to the blocking of his account. He demanded a refund of his total losses amounting to $20,000, arguing that he shouldn't have been allowed to play on the site in the first place. However, we concluded that the request for a refund under these circumstances was unjustified as the player knowingly breached the casino's rules. The player's complaint was thus rejected due to these reasons.

I've been a loyal user since 2020. In the past They've Taken my deposits, withdrew my deposits no trouble at all, but in the end they've taken more than $20,000 of my hard earned money due to supposed fairplay I've invested and lost At least $20,000 into this site to get to Daimond VIP status $1,000,000 wagered with a Daimond chest that paid out only $100 my account name is R*****.

Until recently they now are blocking VPN Access! mind you VPNs aren't illegal but for security and safety.

I contacted support and they told me they can't help me withdraw the remaining balance!

What upsets me the most is that I know they can easily withdraw it for me; mind you I got the crypto address but, support refuses to help! So how In the world would I withdraw since I am now blocked?

What upsets me even more is I feel I've been a loyal member to them and now I am kicked to the curb like nothing because I used VPN. If they would've done a VPN block in the first place I wouldn't have lost over $20,000 trying to get to Daimond. And now they choose to use shady tactics of claiming a $10 fee for my account being dormant from the balance I've got left! So they can't help me withdraw but they can withdraw it for themselves in the form of a fee? Is this a Joke? First of all Signups are free, no verification required! Then what in gods name is with the fee? From my view this seems to be a very shady excuse to claim what I got left and then they close my account for good. Haven't I lost enough already to them?

Do I not have a right to be angry? This is technically fraud! Yes I used VPN And proving where I live isn't required by global law! like I said VPN isn't illegal. They allowed my access VPN in the past and they accepted me and my money like a regular player and every bet I placed. Now they won't help me withdraw my remaining funds and slowly charge me a dormant fee notifying me by email like a slap in the face like an ridicule that I shouldn't have used a VPN! So legally is what what I have left in my account is now thiers to do as they wish? Unacceptable! By charging my dormant account a fee they try to find a non suspicious way to claim it! I can see right through The shadyness if Bitsler like clear as day!

I am upset and will do any means necessary to get all my losses back! I didn't deserve this Treatment I risked alot to get to Daimond status! And facing bankruptcy. I am not proud of my actions but I don't deserve this Treatment from Bitsler.com!

This is the email I got from them

" Your Dormant Account Has Been Charged

Hello R*****,

Your Bitsler account has been dormant for 30 days.

As mentioned in our previous email and our Terms and Conditions (clause 13), we've charged your account a (10) USDT administration fee from your balance.

Your remaining balance is: 14.219238414488999.

If your account remains dormant until (16-02-2024), we will charge a monthly administration fee from your account balance: either 5% of the remaining balance or 10 USDT (whichever is higher).

To make your account active again, simply log in at Bitsler.com. "

My email is dr**********01@gmail.com

If nothing is done then I will find a resolution with the gambling gaming commission and there are many other ways to take Bitsler down from existence.

If Bitsler.com can't resolve this, then I'm sorry say good Bye To your KYC license. Again I mean no trouble, but due to all damages caused and all my money being forced from me I simply want everything back and I be on my way, You can't get away with taking my money and throwing me out like garbage!

Anyway we'll then see what happens to Bitsler.com, enough is enough.

Dear dragonx9001,

Thank you very much for submitting your complaint. I’m sorry to hear about your problem. Please allow me to ask you a few questions, so I can understand the whole situation completely.

  • Is it accurate to say that your account, with a remaining balance of $14, has been blocked due to your acknowledgment of using a VPN, which aligns with the stated reason for the account blockage? I won't contest the casino's decision to block your account, as the prohibition of VPN usage is explicitly outlined in the casino terms (here).

(z) You accept and acknowledge that we reserve the right to detect and prevent the use of prohibited techniques, including but not limited to fraudulent transaction detection, automated registration and signup, gameplay and screen capture techniques. These steps may include, but are not limited to, examination of your devices’ properties, detection of geo-location and IP masking, transactions and blockchain analysis.

  • Can you provide clarification on the nature of the disputed amount? Am I correct in understanding that it reflects your losses in this casino, rather than representing your actual active balance at the time your casino account was blocked?
  • Have you been offered the possibility to withdraw the remaining balance of $14?

If there’s any relevant communication, please forward it to petronela.k@casino.guru.

I hope we will be able to help you to resolve this issue as soon as possible. Thank you in advance for your reply.

Best regards,

Petronela

Yes I'm fully aware of their conditions And that I won't ever be logging in again obviously, but that's besides the point.

Yes it reflects all damages and deception and losses I shouldn't have been on allowed on bitsler in the first place and so return everything back to me yep $20,000 they must give it back because I am illegal to be playing on their site so that is money laundering on their part.

So Why not they Simply just withdraw my funds to my provide crypto address! So they have a right to withdraw it for themselves instead? It's not their money! It's mine I want everything back I have multiple ways to erase this casino from existence.

Understood. I think we can agree that requesting a refund of lost funds should be grounded in more substantial reasons than those presented.

Your history with this casino, dating back to 2020, reflects a pattern of voluntary engagement – depositing, withdrawing, and actively participating. The decision to seek a refund of all your lost deposits, particularly after acknowledging the use of a forbidden VPN when your account balance was at $14, raises questions.

In a hypothetical scenario where you had won money in a casino where your country is restricted, and the casino confiscated your winnings due to geolocation issues, we would certainly strive to assist you. Regrettably, the current situation does not align with that context. We are unable to provide assistance when players from restricted countries seek refunds for their losses, claiming deception by the casino. Your acknowledgment that "I am illegal to be playing on their site" underscores the breach of rules by circumventing their IP block with a VPN. The casino implemented the IP block on their website, and the use of a VPN circumvents this measure. Seeking a refund under these circumstances raises questions about the basis for such a request.

Thank you for your understanding of our position in this matter.
