Malta and the MGA are under enormous pressure - no matter what statement they make, it does not change the fact that the EU Commission must be quite certain to conduct such a procedure.
Why should only Malta be right and not the majority of member states?
Malta is certainly not in the right, but the question is how they will get the money and whether the courts in Malta will then carry out the execution.
Given how Malta has handled it so far, I can only wonder what they will come up with now and how they will respond to the letter.

They can assume whatever they want... if the EU Commission, and in case of doubt the ECJ, declare Bill 55 to be contrary to European law, Malta MUST make a change, as state liability could arise under certain circumstances. And before that happens, they'd rather hand over the casinos to the kingpin.

Yes, but if it goes to the European Court of Justice, it will take years. That's a real shame, considering how long these laws were passed. And then so many more will go bankrupt, and then only those with whom the money is deposited in Malta, or those who were among the first to file lawsuits, will get the money anyway.
I know so many people who have a judgment but don't even have a legal order for execution. Theoretically, none of them could see any money. Besides, we don't even know if the casinos that have so far will pay and settle.
As already mentioned, in over 90% of cases the accused countries do not take legal action before the ECJ.
And as the pressure slowly increases, the Commission will certainly not wait indefinitely to take action.
And even Malta and the casinos located there should come to the realization that they have to find a solution somehow if they don't want to be completely destroyed

Malta must then relent and comply with ALL foreign judgments. That's precisely the crux of the matter. If the ECJ rules that Bill 55 is unlawful (which is where things are headed), Malta must comply with all judgments, not just the enforcement orders. All countries can then invoke the new situation, and Malta will be forced to pay because if it doesn't comply, the EU can impose sanctions on Malta or impose a fine that is definitely higher than the plaintiffs would have to pay.
So let's wait and see how Malta will react to this before everything is painted black again.....

If the casinos are smart, they will pay directly and not allow thousands of judgments to be executed.
If, as expected, the whole house of cards collapses, the casinos will have to be much more economical with court costs, interest, etc.
