Thank you for your response.
However, I must formally dispute your position for the following reasons.
Firstly, I do not accept that I entered into a clear and informed agreement to purchase cryptocurrency.
At no stage was I presented with a wallet address input, blockchain transaction details, or any meaningful confirmation that cryptocurrency was being delivered to me. There was no effective KYC process completed that would ordinarily accompany a regulated crypto exchange transaction.
The absence of these fundamental elements strongly indicates that no properly formed or informed contract was established.
Merely stating that terms were "available" within a checkout widget does not satisfy the legal requirement for transparency and informed consent under UK consumer protection law.
A valid contract requires clear disclosure of the nature of the service being provided. That standard was not met.
Secondly, regarding MCC 6051, while you state that this classification is compliant with Visa and Mastercard rules, the practical effect of coding these transactions as quasi-cash/crypto transactions was to circumvent my bank’s active gambling block.
The underlying purpose of the transaction was not a genuine retail crypto investment initiated independently by me, but rather payments connected to an online gambling platform.
As the merchant of record, Kryptonim Sp. z o.o. remains responsible for ensuring that transaction coding accurately reflects the true nature and purpose of the payment flow.
If you maintain that you provided a legitimate crypto exchange service, then please provide:
The exact wallet address to which the cryptocurrency was delivered,
The blockchain transaction hash (TXID) for each disputed payment,
Evidence that the wallet belongs to me
Records of any KYC verification performed in my name
Without this evidence, your assertion that a completed crypto exchange took place is unsupported.
Given the above, I reiterate my request for a full refund of the disputed transactions.
If this matter cannot be resolved promptly, I will proceed with escalation through my card issuer via chargeback, and submit formal complaints to the appropriate regulatory and supervisory authorities in your jurisdiction, as well as relevant card network compliance channels.
I remain willing to resolve this matter amicably, but I require either (1) documentary proof of the completed crypto delivery as outlined above, or (2) confirmation that the refunds are being processed.
