What is Bill 55?
Bill 55 is a Maltese law.
Many online casinos are based in Malta. These online casinos contribute significantly to Malta's economic output.
Therefore, Malta passed "Bill 55," a law that prohibits the enforcement of foreign judgments (e.g., Austrian judgments) against online casinos in Malta. This is intended to protect online casinos from foreign players claiming their losses.
"Bill 55" – Violation of EU law
In my opinion, "Bill 55" violates EU law. Therefore, the EU Commission has initiated infringement proceedings against Malta. Furthermore, proceedings are pending before the European Court of Justice to determine whether or not "Bill 55" violates European law.
Unfortunately, experience shows that a decision from the European Court of Justice is only expected in two to three years. If "Bill 55" violates EU law and Malta refuses to enforce the foreign judgment, the European Commission can impose coercive penalties (= fines).
However, "Bill 55" does not mean that online casinos from Malta will no longer refund gambling losses at all. This depends on the individual online casino, with some online casinos constantly changing their strategies. In many cases, refunds are made through an out-of-court settlement or after a court case.
