What is Bill 55?

Bill 55 is a Maltese law.

Many online casinos are based in Malta. These online casinos contribute significantly to Malta's economic output.

Therefore, Malta passed "Bill 55," a law that prohibits the enforcement of foreign judgments (e.g., Austrian judgments) against online casinos in Malta. This is intended to protect online casinos from foreign players claiming their losses.

"Bill 55" – Violation of EU law

In my opinion, "Bill 55" violates EU law. Therefore, the EU Commission has initiated infringement proceedings against Malta. Furthermore, proceedings are pending before the European Court of Justice to determine whether or not "Bill 55" violates European law.

Unfortunately, experience shows that a decision from the European Court of Justice is only expected in two to three years. If "Bill 55" violates EU law and Malta refuses to enforce the foreign judgment, the European Commission can impose coercive penalties (= fines).

However, "Bill 55" does not mean that online casinos from Malta will no longer refund gambling losses at all. This depends on the individual online casino, with some online casinos constantly changing their strategies. In many cases, refunds are made through an out-of-court settlement or after a court case.

I haven't been active here for a long time.

Some time ago, I asked if anyone had experience with crypto casinos in Curaçao or had managed to obtain a payout or refund.

Now I have good news:

I was able to negotiate a settlement with a provider for 50% of my net losses – and I actually received the money. It was one of the most difficult decisions of my life. When you desperately need money, it's hard to turn down an offer like that. I accepted it, but clearly expressed my concerns about the contract – because it was quite a stretch.

The post about the €500,000 payout from Stake gives me hope that I might be able to partially recoup my losses there as well. Especially since my payout is significantly higher than with the other provider. So far, I've submitted a claim for 65% to Stake. Unfortunately, Stake.com has proven extremely unreliable when it comes to deadlines.

A lawyer from Curaçao, who supposedly already represents another player (BC.Game), is demanding a $2,000 upfront payment plus a 20% profit share. He claims he can recoup 100% of the losses within two weeks. The payout will be made to the withdrawal-mode-only stake account I still have. Please do your own research first, though. I found the lawyer on bitcointalk.org, so use at your own risk; this is not a recommendation.

About my stake losses:

I have net losses of over USD 50,000 there. I deliberately formulated my demand for more than 65% so that Stake would remain profitable despite the payout and both parties could settle the matter. I'm currently waiting, but I'm concerned that Stake.com or Medium Rare could transfer the license to Anjouan or a similar territory to avoid precisely such demands for reimbursement.

So far, I have acted without a lawyer – simply by citing relevant legal articles and with some support from AI, I have already achieved success.

My tip: Only contact a lawyer once you have received a clear and definitive response from the casino (e.g., an explicit rejection).

Of the approximately five casinos I've filed claims with, I've only received a clear rejection from two. However, these cases only involved three-digit amounts, and it's simply not worth pursuing further legal action.

Hello, which casinos have you been successful with, and how can I contact you? Specifically, I'm dealing with five Curaçao providers, with losses of over 70,000...

I was also able to reach a settlement with a provider from Curacao last year.

However, Stake is still open as a crypto casino, and I haven't found anyone yet who can provide real information or report on any success there.

I wouldn't want to hire the aforementioned lawyer at this time. All I can find on the Bitcointalk forum is one post that doesn't speak very favorably of him.

Has anyone here already tried to reach a settlement with Stake, or even successfully sued/executed? I'd be really interested in hearing about their experiences, as I've lost a considerable amount of money there.

What are Stake's chances of success? What did your lawyer say about this? And has Stake defended itself after the lawsuit was filed, or is everything still too fresh to know?

I'd be happy with 50-60% out of court with Stake. If a lawsuit is the only option, I don't know if I want to take the risk. I currently have many other financial obligations that don't allow me to "gamble" with a lawsuit. However, if the odds are good and German players can also achieve something, I would like to pursue it in the new year.

Hello, this is another scam profile. Nasty practices are unfortunately something we have to deal with on a daily basis in the forum.

I talked to him on Telegram and he gave me some information but he didn't convince me, especially when I tried to find the chat because he suddenly had a different name on Telegram and the chat is gone.

I think some law firms charge the really big fish below their salaries because I've contacted a few of them and either received no response or a rejection.

Stake's Switzerland Customers Policy, which we reviewed as part of the criminal investigation and included in this decision, is dated January 1, 2023. We do not know what regulations existed previously, and we have not reviewed them.
