The comparison is a bit flawed. No average user consults a lawyer or checks license registers for every online payment – this is neither common nor reasonable in everyday life. As a consumer, you rely on a provider who advertises publicly, accepts payments, and performs verification to also operate legally.
Especially if a casino is available in German, accepts common payment providers like Klarna, and has regular terms and conditions, users are given the impression of a legal offering. However, in Germany, a valid license is required by law for online gambling (Section 4 (4) of the GlüStV 2021). Without this license, the offering is not permitted – regardless of what the terms and conditions state.
I contacted the casino to find a straightforward, objective solution, but unfortunately, I was completely ignored. There was no response or clarification – in my opinion, this doesn't speak for their serious behavior.
The responsibility for legal admissibility lies with the provider, not the customer. If an offer violates legal requirements, the contract is void according to Section 134 of the German Civil Code (BGB) – even if the customer has formally agreed to it.
