Dear Casino.guru Complaint Resolution Team,
I am filing this complaint against N1 Bet regarding the unfair confiscation of €341.70 from my balance, resulting from a deeply misleading and predatory application of their Bonus Terms and Conditions, specifically concerning the conflict between Clause 2.3 and Clause 1.9.
The Timeline of Events:
I deposited €100 and received a €25 "4th Welcome Bonus" (Balance: €125.07).
During my gameplay to fulfill the wagering requirements, my balance fluctuated but never dropped below €73.12. This mathematically proves that I never touched the €25 bonus funds; I was exclusively playing with my real money deposit.
I completed the required wagering (approx. €1,000) with my balance peaking at €566.77.
Upon completion of the wagering, the N1 Bet software automatically retroactively applied a "Maximum Win Cap" (Clause 1.9: 5x the bonus amount). My balance was instantly slashed from €566.77 to €225.07 (calculated by the casino as €100 deposit + €125 max win + €0.07). They confiscated €341.70.
The Core Issue: Deceptive and Predatory T&Cs
I do not deny that their software is programmed to execute this cap upon wagering completion. However, I strongly contest that their published Terms authorize them to qualify winnings obtained via real money bets as "bonus-derived" winnings.
N1 Bet explicitly advertises this as a "Non-Sticky" bonus under Clause 2.3, stating verbatim:
"All the bonuses are non-sticky. [...] you start playing for real money first, then for bonus money..."
By stating that players use real money first, the Casino contractually establishes a clear distinction between the real money balance and the bonus balance. It creates the legitimate expectation that winnings generated during the "real money" phase are exactly that: real money.
If the Casino intended for all deposits and all winnings generated while a bonus is merely attached to the account to be subject to the 5x cap—regardless of the origin of the funds—then this is inherently a "Sticky" bonus. Advertising it as "Non-Sticky" while secretly tying the real money deposit to a retroactive bonus cap is a predatory practice designed to trick players into believing their real money winnings are safe.
Conclusion: N1 Bet is weaponizing the ambiguity of their own terms. I respectfully ask Casino.guru to review this practice under your Fair Gambling Codex. A casino cannot claim a player is using "real money first" (Clause 2.3) and then confiscate those exact real money winnings by treating them as bonus funds (Clause 1.9).
I request the immediate reinstatement of the €341.70 that was unfairly confiscated from my real money winnings.
Thank you for your time and assistance.
