Samo da vas obavestim. Prosledio sam svoj slučaj FOS-u, međutim, propisi na Kurasau se trenutno menjaju i zahtevaju od kazina da prođu kroz ADR postupak ako se ne slažete sa ishodom spora.
Bio sam u sporu sa jednim kazinom jer u osnovi nemaju licencu za rad u Velikoj Britaniji, a pružanje usluga u ograničenim zemljama je protivno i zahtevima za licencu Kurasaa i UKGC-u i ne mogu prebacivati krivicu u uslovima i odredbama na korisnika. Obaveza je na operateru.
Obratio sam se CADRE-u i oni su prihvatili moju žalbu i čekaju odgovor od kazina.
Ovo može/ne mora da funkcioniše, ali vam toplo savetujem da se obratite kazinu i zatražite povraćaj novca (ili gest dobre volje), a ako to ne uspe, zatražite da to pokrenete putem dodatnog rešavanja spora.
Trenutno je to dobrovoljna obaveza, ali su mi iz Kadra rekli da će za nekoliko nedelja biti obavezno.
Imao sam uspeha da odem direktno u kazino i dobijem novac nazad.
Troškove ADR-a snosi operater, tako da je verovatno da će ovo dovesti do povraćaja novca s obzirom na troškove ADR-a i potencijalni gubitak u odnosu na samo pružanje povraćaja novca.
Ovo bi moglo potpuno da promeni pejzaž.

Just an update from me. I’ve passed my case to the FOS, however the regulations in curaçao are currently changing to require casinos to go through an ADR if you don’t agree with the outcome of a dispute.
I have been in dispute with one casino as basically they don’t have a licence to operate in the UK and providing services in restricted countries is both against Curacao licence requirements and UKGC and they cannot shift blame in T&Cs to the user. The obligation is on the operator.
I’ve approached CADRE and they have accepted my complaint and are awaiting the response from the Casino.
This may/may not work but I strongly advise you to approach the casino and request refund (or gesture of goodwill) and if that fails ask to raise it with an ADR.
Its currently a voluntary requirement but Cadre have told me in a few weeks it’s going to be mandatory.
I’ve had success going direct to the casino themselves and getting money back.
ADR cost is born by the Operator, so it’s also likely that this may cause refunds given the cost of the ADR and potential loss vs just providing a refund.
This may change the landscape entirely.
