Prvi put sam poslao imejl Swipez-u pre više od 6 nedelja i još uvek nisam dobio nikakav odgovor. Obratio sam se CNB-u nakon 3 nedelje bez odgovora i upravo sam dobio sledeće od njih. Nadam se da će njihova istraga insistirati na nekoj vrsti povraćaja novca. Ukupno je oko 22,5 hiljada dolara.
Dana 15. oktobra 2025. godine, Češka narodna banka (u daljem tekstu „ČNB") primila je Vaš podnesak u kojem skrećete pažnju na ponašanje kompanije Draph Solutions sro, ID 06245242, registrovano sedište: Národní 961/25, 110 00 Prag 1 (u daljem tekstu „kompanija"). Ovaj podnesak nadovezuje se na tri prethodne žalbe poslate ČNB-u u kopiji.
ČNB, kao upravni organ za nadzor finansijskog tržišta u skladu sa Zakonom br. 6/1993 Zb. o Češkoj narodnoj banci, sa izmenama i dopunama, nadgleda, između ostalog, poštovanje obaveza koje su pružaocima platnih usluga nametnute Zakonom br. 370/2017 Zb. o platnim operacijama, sa izmenama i dopunama (u daljem tekstu „Zakon o platnim operacijama"). Kompanija je licencirana kod ČNB kao mali pružalac platnih usluga (tzv. mala platna institucija) i ovlašćena je da pruža (i) izvršenje transfera sredstava na platni račun, osim ako preneta sredstva nisu odobrena kao zajam korisniku od strane pružaoca usluga, po iniciranju platioca, korisnika ili platioca preko korisnika, (ii) izdavanje i administriranje platnih instrumenata i prenos platnog naloga i obradu platnih transakcija, gde je korisnik primalac plaćanja, (iii) vršenje transfera sredstava gde ni platilac ni primalac plaćanja ne koriste platni račun kod pružaoca usluga platioca (transfer doznake). HNB je pokrenula istragu vašeg podneska, koja još nije završena.
HNB nadgleda finansijsko tržište u meri utvrđenoj relevantnim zakonskim propisima. Ovi propisi joj daju pravo da kontroliše da li subjekti koji posluju na finansijskom tržištu poštuju svoje zakonske obaveze i da sankcioniše moguće kršenje obaveza u naknadnim upravnim postupcima. Vršenje nadzora podleže obavezi poverljivosti u skladu sa odredbama člana 239. Zakona o platnom prometu. Čak i u slučaju utvrđivanja nezakonite aktivnosti ili drugog nedoličnog ponašanja, HNB nema ovlašćenje da se meša u privatnopravne odnose između subjekata nadgledanja i njihovih klijenata i da rešava sporove koji proizilaze iz tih odnosa. Prema članu 12. Zakona br. 89/2012 Zb., Građanskog zakonika, sa izmenama i dopunama, klijenti imaju pravo da podnesu tužbu protiv kompanije sudu Češke Republike. U slučajevima navedenim u čl. 1 Zakona br. 229/2002 Zbirke, o finansijskom arbitru, sa izmenama i dopunama, takođe i Finansijski arbitar ( http://www.financniarbitr.cz/en ), potrošači imaju pravo da podnesu zahtev organu nadležnom za rešavanje vansudskih sporova između potrošača i dobavljača.
Slanjem ovog odgovora, HNB se pridržava odredbe člana 42. Zakona br. 500/2004 Zb., Upravnog zakonika, sa izmenama i dopunama, u vezi sa odredbom člana 248. Zakona br. 370/2017 Zb., Zakona o platnom sistemu, i obaveštava Vas da, na osnovu Vašeg podneska, HNB nije utvrdio razloge za pokretanje upravnog postupka po službenoj dužnosti.

On October 15th, 2025, the Czech National Bank (hereinafter "the CNB") received your submission in which you draw attention to the conduct of the company Draph Solutions s.r.o., ID 06245242, registered office: Národní 961/25, 110 00 Prague 1 (hereinafter "the company"). This submission follows on from three previous complaints sent to the CNB in copy.
The CNB as the administrative authority for supervision of the financial market pursuant to Act No. 6/1993 Coll., on the Czech National Bank, as amended, supervises, inter alia, compliance with the obligations imposed on payment service providers by Act No. 370/2017 Coll., on payments, as amended (hereinafter "Act on Payments"). The company is licensed with the CNB as a small-scale payment service provider (so-called small payment institution) and is authorised to provide (i) execution of transfer of funds on a payment account, unless the tranferred funds are granted as a loan to the user by the provider, initiated by the payer, the beneficiary or the payer through the beneficiary, (ii) issuing and administering payment instruments and transmission of payment order and processing of payment transactions, where the user is the payee, (iii) making a transfer of funds where neither the payer nor the payee uses a payment account with the payer's provider (remittance transfer). The CNB has opened an investigation of your submission, which has not yet been completed.
The CNB supervises the financial market to the extent specified in the relevant legislation. These entitle it to control whether entities operating on the financial market comply with their legal obligations and to sanction possible breaches of obligations in the subsequent administrative proceedings. The exercise of supervision is subject to the obligation of confidentiality pursuant to the provisions of Art. 239 of the Act on Payments. Even in the case of a finding of an illegal activity or other misconduct, the CNB does not have the authority to interfere in the private legal relations between supervised entities and their customers and to adjudicate disputes arising from these relations. According to Art. 12 of the Act No. 89/2012 Coll., Civil Code, as amended, customers have the right to file a lawsuit against the company with the court of the Czech Republic. In the cases specified in Art. 1 of Act No.229/2002 Coll., on the Financial Arbitrator, as amended, also the Financial Arbitrator (http://www.financniarbitr.cz/en), consumers are entitled to file an application with the authority responsible for settling out-of-court disputes between consumers and providers.
By sending this reply, the CNB complies with the provision of Art. 42 of Act No. 500/2004 Coll., the Administrative Code, as amended, in connection with the provision of Art. 248 of Act No. 370/2017 Coll., the Payment system act, and informs you that, based on your submission, the CNB has not found the reasons for the opening ex officio administrative procedure.
