While Kalshi may have enjoyed a certain privilege in attracting Donald Trump Jr. as an advisor, and has generally been favored by the White House’s favorable stance on prediction markets, the platform has drawn the line at politicians engaging in insider trading.
In a recent announcement of enforcement action against trading accounts, the platform confirm dthat former US Congressman George Santos will be permanently banned from the platform, after it was proven that he place trades on whether he would attend President Donald Trump’s State of the Union address.
Santos has, admittedly, not taken too kindly to the news and has been outright belligerent. "Thanks for the lifetime ban from your gambling platform," Santos wrote. "Let’s see how much longer you guys are around for," he added. The belligerent was not justified, especially when Santos admitted to the offenses.
His defense ran on the lines that he had placed the trade to demonstrate the "imperfect nature" of prediction markets, and how some people "would make money they didn’t expect" and some would lose money.
Kalshi similarly issued a $71,356 fine, which is well within its rights as a federally-licensed exchange, costing the former US Congressman even more than the $35,000 fine he was ordered to pay by the Commodity Futures Trading Commission (CFTC), the official overseer of prediction markets.
Santos dalliance with prediction markets has cost him also his political career, after he was expelled from congress in 2023, and a year later pleaded guilty to federal wire fraud and identity theft, with a seven-year prison sentence struck down by President Trump after 84 days served.
It’s worth noting that Santos has previously endorsed Polymarket, a company that is the main rival of Kalshi in the United States, and which saw Trump Jr. recently lead a funding round into it and invest $300m. Trump Jr. is also an advisor to Kalshi, however.
Santos comments could be interpreted as frustration or a hint that the White House may have picked sides in the prediction market race, with Polymarket favored.
Beyond speculation, Kalshi’s action against Santos represents an important turning point, with the platform sending a clear message - it doesn’t matter who you are; if you engage in inside trading, the platform is coming for you.
